This Terms and Conditions document governs the use of Dynavector Online’s Service (the Service) including shopping and participation in promotions run by Dynavector Online. You can access this Agreement at any time from the bottom of any page of the site.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Dynavector Online or its content suppliers and protected by Australian and international copyright laws. Shopping Terms & Conditions

Purchasing from Dynavector Online

Dynavector Online shopping gives customers convenient, quick, easy and secure shopping.   We only ship goods within Australia, international guests can refer to the links page to locate the nearest distributor to them.

 

While Dynavector Online is a newly established service, we have been operating our wholesale business in Australia for over 20 years.  We are the sole Australian Distributors for all the products we represent.   Our contact details show our physical location in Sydney and so you can be assured that you are dealing with a reputable company.

 

Products displayed on the site shopping areas can be purchased using secure online MasterCard, Visa, and Bankcard credit cards. Customers can be confident that all of their details are protected by the latest security mechanisms and are used only for purposes of the transaction fulfilment.

 

You will be asked to register as a member of Dynavector Online.  Apart from the many member benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you checkout.

We must receive payment details for the whole of the price for the goods that you order and all monies owing before your order can be accepted. Once payment details have been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form. We will not charge your credit card until your order is ready to be dispatched to you. Our acceptance of your order brings into existence a legally binding contract between us.

 

Pricing

All prices in the shopping areas are in Australian dollars (AUD) and include GST (10% Goods and Services Tax). All prices are correct at time of publication, however we reserve the right to alter prices for any reason without notice. If this should happen after you have ordered a product, we will contact you prior to processing your order.

 

 

30-Day Kimber Kable and BDR Home Trial and or Cancelling your order.

Try Kimber Kable and most BDR (Black Diamond Racing) products in your own system at home. If at any time you decide that these products do not suit you, then simply return them within 30 days for a full refund or exchange, see Return of Goods section below for conditions on returning goods. 

 

Custom made cables and any non-standard cables are excluded from our 30 day home trial period.  The complete list of standard cables and an explanation of why we limit the exchange policy to standard length cables is contained on our information page called "Standard Cables".  (See link in left hand column).  A basic summary of standard cables is listed below.   BDR Thick Pucks,  ETJ Pucks and custom products like The Shelf and The Source are excluded from the 30 day home trial.

To cancel your order (i.e. not returning the items for an exchange item) you must notify us in writing (letter, fax or e-mail).  

 

For full information on how to return products under our 30-Day Home Trial, please refer to the Return of Goods section below.

 

Once you have returned the Kimber or BDR products to us under the 30 Day Home Trial, any sum paid to us from your credit card will be refunded to your account as soon as possible and in any event within 30 days of your cancellation provided that the goods are returned as set out in the Return of Goods section below.

 

If we cancel your order

We reserve the right to cancel your order for the following reasons:

  • We do not deliver to your location.  Note we only deliver goods within Australia unless by special agreement from the manufacturers of the products we represent.
  • One or more of the goods you ordered was listed at an incorrect price due to typographical error or an error in the pricing information received by us from our suppliers.
  • We have reason to suspect that credit card details are incorrect or you are not the authorised cardholder.
  • Your contact details and or shipping address is incomplete.  Please note: Most courier companies, including Startrack Express cannot deliver to a PO Box.

If we do cancel your order we will notify you in writing (by letter, e-mail or fax) and will refund to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.

We shall have no liability to you for any loss suffered as a result of cancellation of your order.

 

 

Delivery

Delivery will be made as soon as possible after your order is accepted and normally within 7 days of your order. Non standard cable lengths and custom made products and may take longer, we will notify you of an estimated delivery time when we have processed your order.

You will become the owner of the goods you have ordered when they have been delivered to you unless your payment has been reversed by a financial institution.

 

Once goods have been delivered to you, you will assume all risk  for their security and use.  We will not be liable for their loss, damage, destruction or any loss, damage or destruction occurring as a result of their use.

 

Events beyond our control.

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdowns, failure of network access, flood, fire, explosion or accident.

 

Incorrect, Faulty or Damaged Goods.

Dynavector Online will replace any goods delivered to you that are incorrect or in a faulty or damaged condition.  Under these circumstances we will refund the cost of return freight.

 

If the packaging appears to be damaged at time of delivery, you must advise the freight company immediately and note any damage in writing before signing for any goods.  If you do not notify the freight company immediately of any visible signs of damage we shall have no liability to you.

 

You must notify us in writing (letter, fax or email) immediately upon receipt of any freight-damaged goods and no later than 7 working days of receiving incorrect, faulty or damaged goods.  If you have not notified us within 7 working days of the delivery of the goods in question, we shall have no liability to you.

 

Any incorrect, faulty or damaged goods must be returned to us unless otherwise agreed in writing, before any refund will be made.  See Return of Goods section for details on returning goods.

 

 

Return of Goods

If you wish to return goods to us, you must notify us in writing (letter, fax, email) and we will send you a return form to complete.  The return form will request the following information:

·        Your name and daytime contact number:

 

Any returning goods must be returned to us in their original condition, packed in the original manufacturers packaging and then placed in a strong outer carton for shipping.  Do not ship only in the original manufacturers packaging.  Please ship the goods to the following address:

For items with a value over $30.00 we strongly recommend using a traceable return freight method.  For example using a courier company, Australia Post Yellow Bag, Certified or Registered Mail.  We cannot be held responsible for returning items damaged or lost in transit.  It is our opinion that standard parcel post is not secure.

We can also arrange to have the goods collected from you by our couriers and the cost of the return freight will be deducted from any refund.  Please contact us for details if you require this service.

Goods are returned to us at cost and risk.

 

Security.

We use the secure GeoTrust Premium SSL security certificate to process all online orders and to protect login details.  This is an SSL 128 to 256 bit secure solution.  Refer to www.geotrusteurope.com for further details of this security system.  Also check for the padlock in the bottom right hand corner of any secure pages or press the GeoTrust logo in the left hand column for verification of Dynavector Online’s current security certificate.

 

 

Use of the Service by you.

Your right to use the Service is personal to you. You may not authorise others to use the Service, and you are responsible for all of your own use of the Service and for preventing unauthorised use of the Service.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Dynavector Online does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use Dynavector Online only with involvement of a parent or guardian. Dynavector Online reserves the right to refuse service, terminate accounts, remove and or edit content.

 

You may not download, modify, transmit, or otherwise use any material from the Service for public or commercial purposes.

 

Other than connecting to Dynavector Online’s servers by HTTP requests using a web browser, you may not attempt to gain access to Dynavector Online’s servers by any means, including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service or otherwise.

 

You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way and you agree not to impede or interfere with others’ use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, Dynavector Online and/or the Service.

 

Disclaimer

This Service provides general information about Dynavector Online and the products and services they offer. The information contained in the Service has been prepared solely for the purpose of providing information about Dynavector Online and the services and products we offer. Dynavector Online reserves the right to change, delete or move any of the material on the Service at any time without notice.

 

Dynavector Online shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages sustained arising out of your access to or inability to access the Service. This includes viruses alleged to have been obtained from the Service, your use of or reliance on the Service or any of the information or materials available on the Service, regardless of the type of claim or the nature of the cause of action.

 

If any parts of these terms and conditions is unenforceable (including any provision in which we exclude or limit our liability to you) the enforceability of any other part of these conditions will not be affected.  Your rights under the Australian Trade Practices Act are not limited by these terms.

 

Applicable Law

The Website (excluding any linked third party Websites) is controlled by Dynavector Online. By accessing this Website, you accept that any disputes about this Website or the Content are to be determined by the Courts having jurisdiction in New South Wales (“NSW”) Australia in accordance with the laws in force in NSW.

Although this Website can be accessed throughout Australia and overseas, Dynavector Online does not represent that the content of this Website complies with the laws (including the intellectual property laws) of countries outside Australia. If you access this Website from outside Australia, you do this on your own responsibility and are responsible for ensuring compliance with all laws in the place where you are located.
